Terms of Service

Welcome to Maniac. These Terms of Service (“Terms”) govern your access to and use of Maniac’s websites, SDKs, APIs, cloud platform, and related services (collectively, the “Services”).
By using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

1. Definitions

1.1 “Customer,” “you,” or “your” means the person or entity using the Services.
1.2 “Customer Content” means prompts, inputs, datasets, tools, documents, configurations, and model outputs you submit to or generate via the Services.
1.3 “Telemetry” means technical logs and metadata the Services collect (e.g., latencies, token counts, route decisions, error codes, eval scores).
1.4 “Self-Hosted” means software we provide for you to deploy in your infrastructure (e.g., VPC/on-prem).
1.5 “Cloud” means the Maniac-hosted offering.
1.6 “Order” means an online sign-up, pricing page, or written order form referencing these Terms.

2. Services; Accounts

2.1 Overview. Maniac provides tools to experiment, evaluate, and route AI requests across models, prompts, and pipelines, with observability and policy controls. SDKs and an OpenAI-compatible API are provided for integration.

2.2 Accounts. You must create an account and keep credentials confidential. You are responsible for all activities under your account.

2.3 Cloud vs. Self-Hosted. Cloud requires an account and internet connectivity; Self-Hosted is deployed by you and may require your infrastructure, security, and compliance controls.

2.4 Beta/Preview Features. We may label features as alpha/beta/preview; they are provided as-is and may change or be discontinued.

3. Customer Responsibilities

3.1 Lawful Use. You will use the Services in compliance with all applicable laws and third-party terms (including model provider terms you choose to use).

3.2 Acceptable Use. You will not: (a) misuse, disrupt, or overload the Services; (b) probe or circumvent security; (c) reverse engineer non-open components; (d) use the Services to develop competing hosted offerings by copying proprietary functionality; (e) submit unlawful, harmful, or infringing content; or (f) violate export controls or sanctions.

3.3 Model Providers & Tools. If you route to third-party models or tools (open-source or commercial), you are responsible for applicable licenses, usage limits, and data handling required by those providers.

3.4 Seats/Keys. API keys are per-customer (and where applicable per-org/project). Do not share keys publicly.

4. Customer Content; Data Rights

4.1 Ownership. As between you and Maniac, you own Customer Content. Maniac claims no ownership rights in your inputs or outputs.

4.2 License to Provide the Services. You grant Maniac a non-exclusive license to host, process, transmit, display, and analyze Customer Content and Telemetry solely to: (a) provide, maintain, and secure the Services; (b) operate evaluations and routing you configure; (c) prevent abuse; and (d) comply with law. Where legally permissible, we may use aggregated/de-identified Telemetry to improve the Services.

4.3 Confidentiality. Each party will protect the other’s confidential information with reasonable care and use it only as permitted under these Terms.

4.4 Data Residency & Retention (Enterprise). Upon request and where supported, we will apply data residency, retention, and redaction policies described in your Order or DPA.

4.5 Sensitive Data. Do not submit regulated data (e.g., PHI, PCI, children’s data) unless your plan and Order explicitly permit it and required agreements are in place (e.g., BAA).

5. Open Source; Self-Hosted

5.1 Open-Source Components. Some components may be offered under separate open-source licenses. Those licenses govern to the extent of any conflict.

5.2 Self-Hosted Responsibility. For Self-Hosted deployments, you are responsible for installation, upgrades, backups, keys/secrets, and security hardening unless otherwise agreed in an Order.

6. Pricing; Billing; Credits

6.1 Standard (Pay-As-You-Go). Usage is billed via credits purchased through Stripe or another listed payment method. Credits are consumed by API usage (e.g., tokens, requests, storage, eval runs). Unless required by law, credits are non-refundable. We may offer spend caps and alerts.

6.2 Enterprise. Enterprise pricing, payment terms (invoice/PO), SLAs, professional services (e.g., white-glove onboarding and forward-deployed engineering), and data controls are set out in your Order or MSA.

6.3 Taxes. Fees are exclusive of taxes; you are responsible for applicable taxes except those based on Maniac’s net income.
